By using thomas-beach.com, booking a session at book.thomas-beach.com, viewing a client gallery, or otherwise engaging with Thomas Beach Photography ("we," "us," "our"), you agree to these Terms & Conditions. If you do not agree, please do not use our services.
Services
Thomas Beach Photography provides photography and videography services, including portrait, graduation, couples, family, real estate, drone, and commercial photography. Specific deliverables, timelines, and pricing are confirmed in writing on a per-session basis at booking.
Booking & Deposits
- Sessions are reserved on a first-come, first-served basis when the booking form is submitted at book.thomas-beach.com.
- A non-refundable deposit (typically 25% of the session fee) is required to hold the date. Until the deposit is captured, the slot is not reserved.
- The remaining balance is due on or before the session date and is collected via a Stripe payment link or alternative method (Venmo, Zelle, cash) by arrangement.
- Sessions may be requested via the request flow; we will confirm or decline within 24 hours. If declined, any deposit authorization is released and no charge is made.
Cancellation & Rescheduling
- By you, more than 7 days before the session: deposit is forfeited; remaining balance not charged.
- By you, 7 days or less before the session: full session fee may be charged.
- Rescheduling with at least 48 hours notice is generally accommodated at no additional charge, subject to availability.
- By us, due to illness, weather, or equipment failure: full refund or rescheduling at your option, at no penalty.
- Weather-dependent sessions (outdoor portraits, real estate exteriors, drone): we may proactively recommend rescheduling if conditions are unsuitable.
Image Delivery & Galleries
- Edited images are delivered via a private gallery at clientgalleries.thomas-beach.com within the timeframe agreed at booking (typically 1–3 weeks).
- Gallery access is gated by a PIN provided after the balance payment clears.
- Galleries remain online for at least 90 days; you will receive an expiration reminder before any gallery is taken down. We recommend downloading all images promptly.
- We retain a backup copy of finished gallery files for 12 months after delivery as a courtesy. After that period, we may delete files without notice; clients are responsible for their own long-term archival.
License & Copyright
Unless explicitly agreed otherwise in writing:
- Copyright in all photographs remains with Thomas Beach Photography.
- You receive a personal, non-exclusive license to use the delivered images for personal, non-commercial purposes (printing, sharing, social media).
- Commercial use, resale, modification, or licensing to third parties requires separate written permission.
- We may use delivered images in our portfolio, on our website, and on social media unless you opt out in writing at the time of booking.
- Real estate and commercial clients receive a license appropriate to the agreed use case, documented in the booking confirmation.
Payment
- Payments are processed by Stripe. We never see or store your card details.
- Credit card payments include a small processing fee (the Stripe link displays the exact amount before you confirm).
- Fee-free alternatives (Venmo, Zelle, cash, check) are available on request.
- Refunds, when due, are issued to the original payment method within 5–10 business days.
SMS Terms of Service
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Mobile opt-in data is shared only with our SMS messaging service provider (Twilio) strictly to deliver the messages you opted in to receive.
Program description
Thomas Beach Photography operates a transactional SMS program. By opting in, you agree to receive automated SMS messages related to your photography session at the mobile number you provide.
How to opt in
You opt in to SMS messages by explicitly checking an unchecked box labeled "Text me about my session" on the booking form at book.thomas-beach.com. Opting in to SMS is optional — you can book a session without it, and every message we send via SMS is also delivered via email.
Message types
After opting in, you may receive: booking request confirmations; appointment reminders (24 hours and 2 hours before your session); balance payment links when your session balance is due; gallery delivery notifications with access link and PIN; and cancellation acknowledgments. All messages are transactional. We do not send marketing, promotional, or recurring messages.
Message frequency
Message frequency varies based on your booking activity. A typical booking results in up to 5 messages across the lifecycle of a session.
Cost
Message and data rates may apply. Standard messaging charges from your mobile carrier may apply to each SMS you receive. We do not charge any fee for SMS notifications.
Help and opt-out
Reply HELP for assistance. Reply STOP, CANCEL, UNSUBSCRIBE, QUIT, or END to any message to stop receiving SMS. Once you opt out, we will not send further SMS messages and we will record your opt-out preference so future bookings using the same phone number remain opted out unless you explicitly opt back in.
Carrier disclaimer
Carriers are not liable for delayed or undelivered messages. Message delivery depends on carrier network conditions and cannot be guaranteed.

Website Use
- You may not attempt to access administrative or private gallery pages without authorization.
- You may not submit forms with fraudulent, malicious, or automated traffic. Form submissions are protected by Cloudflare Turnstile and similar protections.
- You may not scrape, reverse-engineer, or otherwise extract content from this website beyond personal browsing.
- Linking to our website is permitted; framing or embedding without permission is not.
Liability
To the extent permitted by law, our liability for any photography session is limited to the fee paid for that session. We are not liable for any indirect, incidental, or consequential damages. Photography is an artistic service; we make no warranty that you will be satisfied with the creative interpretation, only that we will exercise professional care and judgment.
For weather, lighting, equipment failure, or other circumstances beyond our control that affect the session, our sole obligation is to offer rescheduling or refund as described above.
Indemnification
You agree to indemnify and hold Thomas Beach Photography harmless from any claim arising out of your misuse of delivered images (e.g., publishing images of third parties without their consent) or your breach of these Terms.
Privacy
Our handling of your personal information is described in the Privacy Policy, which is incorporated into these Terms by reference.
Governing Law
These Terms are governed by the laws of the State of Nevada, USA. Any dispute will be brought in a court of competent jurisdiction in Washoe County, Nevada.
Changes
We may update these Terms from time to time. Changes are effective when posted to this page; the "Last updated" date at the top reflects the most recent revision. Continued use of our services after a change indicates acceptance of the updated Terms. Material changes to refund, license, or SMS terms will not be applied retroactively to bookings already in progress.
